New Mexico has the highest rate of untested sexual assault evidence kits per capita in the nation. We’ve talked to advocates, a nurse and law enforcement about their surprise and struggles with decades of ignored evidence in the state. But even if a prosecutor has DNA to use in court, that doesn’t mean an accused rapist is going straight to jail. The biggest hurdle of all might be how hard it is to convince people that survivors are telling the truth.

The Department of Justice has scrutinized just two universities in the country about campus assault and harassment: The University of Montana and the University of New Mexico. Results of the DOJ probe in Montana were revealed in May 2013. The findings letter for UNM came out at the end of April this year.

The criminal justice system is still adjusting.

The Constitution guarantees criminal defendants the right to a speedy trial. But how speedy is speedy? The Supreme Court agreed on Wednesday, Jan. 27, to alter controversial rules that sped up criminal cases in the state’s most populous county.

Comment from Mayor Richard Berry's office: “We trust the judicial system will provide the family, our community and the officers a fair, transparent and unbiased opportunity to explore and present the facts as they relate to this tragic event. It is important for all of us to allow the process to progress without prejudice in order for our community to move forward.”
