| Lawsuit Against New Mexico Youth Organized is Dismissed |

A state district judge has dismissed a lawsuit against two New Mexico non-profits accused of campaigning earlier this year. The lawsuit was filed by three Democratic incumbent state lawmakers who lost in the June primary. They alleged that New Mexico Youth Organized, or NMYO, coordinated with their political opponents on a series of mailings.
The suit filed against NMYO and its parent organization, the Center For Civic Policy, was dismissed yesterday. Judge Linda Vanzi said the main defendant in the suit, the Center For Civic Policy's Eli Lee, was not a proper party to an election contest.
Matt Brix is the policy director for the Center For Civic Policy. He says the organization feels vindicated.

The mailings mentioned in the lawsuit contained information about incumbent state lawmakers voting records. Brix says he believes the lawsuit was an attempt to muzzle nonprofits from educating the public about how lawmakers vote.
State Senator Shannon Robinson, who filed the lawsuit, says he wasn’t surprised by the news.

Robinson said he believes Judge Vanzi is politically aligned with the organizations, and he says he expects a different result from the state supreme court.
The Secretary of State ordered NMYO to register as a political action committee, or PAC, in August. It is not yet clear how the dismissal of the lawsuit might affect that ruling. |
