Haussamen Publications Inc. sues NMFA for unreleased subpoena

A blogger and writer for the New Mexico Independent is suing the state’s Finance Authority, or NMFA, for withholding information that is part of a federal pay-to-play investigation of Governor Bill Richardson’s administration.

Heath Haussamen is the publisher of a political website. He says his lawsuit against the NMFA’s custodian of public records, Connie Marquez-Valencia, is simple. He wants to see the subpoena received by the Authority from the federal grand jury regarding contract deals with CDR Financial Products Incorporated.

CDR was a financial adviser for transportation bonds in New Mexico and the federal investigation is examining how they got that job, particularly because two Richardson political action committees received donations from CDR, or CDR employees.

Two federal subpoenas were issued in light of the investigation, one to the Governor’s office, the other to the NMFA. In January, Reymond Romero of the NMFA denied Haussamen’s original subpoena request saying “release of the requested documents could compromise or impede an ongoing federal investigation.”

Haussamen says he was able to get a copy of the Richardson office subpoena. Some of the names in that request include former Richardson chief of staff David Contarino and political adviser Michael Stratton. Others include CDR Chief Executive David Rubin and Colorado state Senator Chris Romer.

HAUSSAMEN: “It gave a lot of information to the public about what the grand jury was looking in to, and specifically, where they were going. And I suspect that the subpoena the NMFA received, could have the same name, or could have different names that give the public a greater understanding of what’s going on.”

Haussamen filed the lawsuit against the New Mexico Finance Authority two weeks ago in Dona Ana’s District Court.

The Authority responded to the lawsuit by saying “NMFA is providing full disclosure and complying with the Department of Justice’s direction to not impede or compromise their investigation in any manner.”

Haussamen says if Haussamen Publications Incorporated wins its case against the New Mexico Finance Authority, he will publish the records on his website.
